User Agreement

Consent

By registering and using the Almeria Industries SRL product(s)(s), the user consents to the collection, storage, and processing of their data by the Almeria Industries SRL product(s)(s) for the purpose of providing the Almeria Industries SRL service(s). The user has the right to withdraw their consent at any time in accordance with applicable laws.

Purpose of Data Usage

The data provided by the user during registration and data transferred using the Almeria Industries SRL product(s)(s) will only be used for the purpose of providing the Almeria Industries SRL product(s)(s) functionality, including file transfer and related features.

Third-party Data Sharing

The Almeria Industries SRL does not share user data with any third parties, except as required by law or as necessary to provide the Almeria Industries SRL service(s), such as with hosting providers or technical support service(s).

International Data Transfers

The user acknowledges and agrees that their data may be transferred to and processed in countries outside their country of residence, including countries that may have different data protection laws, as necessary for the provision of the Almeria Industries SRL service(s).

User Responsibility

The user is solely responsible for the data they transfer using the Almeria Industries SRL product(s)(s) and ensuring that they have the necessary rights and permissions to transfer such data. The Almeria Industries SRL shall not be liable for any unauthorized or illegal transfer of data by the user.

Data Security

The Almeria Industries SRL will take reasonable measures to secure the stored data, including implementing appropriate technical and organizational safeguards to protect against unauthorized access, data breaches, and other security risks. However, the user acknowledges that no security measures are foolproof and that the Almeria Industries SRL cannot guarantee the absolute security of the stored data.

Updates to the User Agreement

The Almeria Industries SRL may update the User Agreement from time to time, and the user will be notified of any material changes. Continued use of the Almeria Industries product(s)(s) after such changes constitutes acceptance of the updated User Agreement

Dispute Resolution

Any disputes arising out of or in connection with the use of the Almeria Industries SRL product(s)(s) shall be resolved through arbitration in accordance with the rules of the designated arbitration body, or through other mutually agreed-upon dispute resolution mechanisms. Jurisdiction and venue for any legal actions shall be determined based on the laws of the governing jurisdiction

GDPR Compliance

The Almeria Industries SRL shall comply with applicable data protection laws, including the General Data Protection Regulation (GDPR), and shall take appropriate measures to protect the rights and privacy of users in accordance with such laws.

Disclaimer of Warranties and Limitation of Liability

The Almeria Industries SRL product(s)(s) is provided on an as is basis, and the Almeria Industries SRL disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Almeria Industries SRL shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Almeria Industries SRL product(s)

Data Storage

The Almeria Industries SRL product(s)(s) may store the following information provided by the user:

- First Name

- Last Name

- Email address

- Name

- Job Title

- Ssh keys

- Passwords

- IP and hosts for destinations

The Almeria Industries SRL shall take appropriate measures to protect the stored data in accordance with applicable laws and regulations. However, the user acknowledges that the Almeria Industries shall not be liable for any loss or damage to the stored data, including but not limited to data breaches, data loss, or unauthorized access.

Termination

The user may terminate their use of the Almeria Industries SRL product(s)(s) at any time by deleting their account. The Almeria Industries SRL product(s) may terminate or suspend the users access to the Almeria Industries SRL product(s) at any time for any reason, including but not limited to breach of the User Agreement or violation of applicable laws.

Indemnification

The user agrees to indemnify and hold harmless the Almeria Industries SRL and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, and expenses, including reasonable attorneys fees, arising out of or in connection with the users use of the Almeria Industries SRL product(s), including but not limited to any breach of the User Agreement or violation of applicable laws.

Entire Agreement

The User Agreement constitutes the entire agreement between the user and the Almeria Industries SRL regarding the use of the Almeria Industries SRL product(s)(s) and supersedes all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral, regarding the same subject matter.

Severability

If any provision of the User Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

Waiver

The failure of the Almeria Industries SRL to enforce any provision of the User Agreement shall not be deemed a waiver of such provision or the right to enforce such provision at a later time.

Assignment

The user may not assign or transfer any rights or obligations under the User Agreement without the prior written consent of the Almeria Industries SRL . The Almeria Industries may freely assign or transfer its rights and obligations under the User Agreement.
